Terms & Conditions – Frosty Fruits Ski Trip 2012

All reservations are subject to availability and rates shown are per person and in Australian dollars.

Deposits & Final Payments

  • A deposit of $500.00 or an agreed and active Payment Plan is required to secure your booking and must be made upon booking to secure your place. Failure to do so will result in the reservation being automatically cancelled without notice.
  • Final Payment of the balance of the Total Cost of your package, as advised at time of booking, must be made in full by July 18, 2012, unless an agreed and active Payment Plan is in operation. Failure to do so will result in the loss of deposit monies. Failure to make the final payment on time will result in the booking being automatically cancelled without notice. Cancellation fees will be charged in accordance with the Cancellation Conditions set out below.
  • If the reservation is made on or after July 19, 2012, immediate payment in full of the Total Cost is required at the time of making the reservation unless otherwise notified to you at the time the reservation is made.
  • For payments initiated via PoDE (and not via a Payment Plan) a 3% (MasterCard, Visa) merchant fee will be added if a credit card is used for payment. A 3% PayPal merchant fee will be added if PayPal is used for payment. If any cancellations are made, the merchant fee will not be refunded.
  • Payments made through the Points of Difference Events website may also incur a nominal handling charge.
  • Payment Plans may incur separate credit card fees, and these will be disclosed in any Payment Plan agreement.

Cancellation Fees
Cancellations must be in writing. Cancellation fees will be charged on confirmed bookings in accordance with the following Cancellation Conditions. Failure to make final payment on the due date will result in an automatic cancellation of the booking without notice and the following Cancellation Conditions will also apply.

Cancellation Conditions 

  • Bookings cancelled on or before June 19, 2012 are subject to a cancellation fee of 100% of the Deposit paid;
  • Bookings cancelled after June 19, 2012 and before July 19 2012 are subject to a cancellation fee 50% of the Total Cost or 100% of Deposit paid, which ever is greater;
  • Bookings cancelled on or after July 19 2012 are subject to a cancellation fee 100% of the Total Cost, that is there will be no refund;
  • Booking cancellations involving a Payment Plan may incur additional cancellation charges as laid out in the Payment Plan Agreement.

Event Tickets
There are no exchanges or refunds for event tickets/passes once bookings have been confirmed. This is in-line with the Entertainment Industry Code of Fair Practice.

Accommodation
All accommodation pricing is based on a per person, twin share rate unless otherwise stated. Bookings for the Frosty Fruits Ski Trip are deemed to be of a social type, and unless specifically request and paid for, all accommodation shall be of a shared nature. That is, guests are required to share apartments and bedrooms with other guests. Every effort shall be made to accommodate any rooming requests, however room allocation shall be at the discretion of PoDE. Further PoDE shall not be held responsible for guest behaviour.

Single and group bookings are available, dependant on rooming availability at time of booking.

Should you book at a Triple/Quad Share rate, and your party not meet the required numbers, you rate will revert to a Twin Share rate. Should your request to share a room at a Twin Share or Triple/Quad Share rate not be met, you have the optios to upgrade to a solo use room or have a full refund of your deposit.

Should you book at an Apartment Rate, the per person rate for your group will be calculated by dividing the Apartment Rate by the number of people in your group. Should your final numbers increase or decrease, the rate will be recalculated and all members of your party will be required to meet the new rate.

Weather Conditions
Under no circumstances can Points of Difference Events Pty Ltd, Hotham Alpine Resort or any of the property owners be held responsible for snow or weather conditions, nor can any booking be cancelled other than in accordance with the cancellation policy detailed above.

Photographic Release
Points of Difference Events Pty Ltd hires photographers and staff who may be producing promotional and publicity pictures or video during your trip. Further, guests may take photographs or similar of you and provide these to Points of Difference Events Pty Ltd. Whether or not signed by you, this Agreement shall be deemed to be an agreement by you, and on behalf of all other persons travelling under this agreement and hereby to grant Points of Difference Events Pty Ltd, its successor, licensees and assigns, all rights of every kind in perpetuity to the use of your photograph or likeness in all forms and media and in all manners, for marketing or any other lawful purposes, without limitations, at Points of Difference Events Pty Ltd sole discretion. You hereby release Points of Difference Events Pty Ltd, its agents and their respective employees, principals, and representatives from any liability, loss, expense, damages, or claims arising from distribution, broadcast, sale or use of your likeness or voice. If you do not desire to be part of future marketing materials, you may rescind this release in writing upon arrival or at any time prior to your return from the event. After your return, the right to so rescind shall be forever waived.

Baggage
Cartage of baggage to and from the Mount Hotham Ski fields shall be via the relevant carrier for example, QantasLink or other appointed company, as advised at time of departure.
The relevant Baggage conditions shall be as stated by the carrier, under their terms and conditions.
Points of Difference Events Pty Ltd and any of it employees or agents shall not be held responsible for guests luggage.
Passengers are advised to remove all carry-on baggage while disembarking at meal, rest and other stops. Carry-on baggage is any item carried aboard coach or aircraft by a passenger and includes, but is not limited to, handbags, clothing, books, magazines, electrical equipment and components, cash, credit cards, art work, passports, jewellery, antiques and any other valuable items.

Insurance
It is advisable for all passengers travelling to have appropriate insurance prior to the event.

Changes, responsibility and further conditions:
All information in respect of goods and services offered, including prices, is subject to alteration or withdrawal without notice. Points of Difference Events Pty Ltd, Hotham Alpine Resort, Hotham Ski Company, and all Independent Operators reserve the right to alter, amend or cancel all or any arrangements, bookings or prices in regard to accommodation, tours or packages for any reason whatsoever.

Activities booked may be hazardous and involve risk to participants. Participants should carefully assess risks and their own fitness levels in choosing activities. No responsibility or liability is accepted or undertaken by Points of Difference Events Pty Ltd, its employees, agents or contractors, Hotham Alpine Resort, Hotham Ski Company, its employees, agents or contractors or any Independent Operator, its employees, agents or contractors for any death, injury, accident, delay, damage to personal property (including baggage) or any other matter arising from any act, omission or thing outside of their control.

In addition to the terms and conditions set out above, any booking is subject to such further terms and conditions as advised at the time of booking or as may be displayed at the time of utilisation of the item or service. Any provision of, or the application of any provision of, these term and conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or any other jurisdiction.

Event Cancellation
In the situation of the event being cancelled, then any deposit monies will be refunded, unless booking was cancelled by guest prior to event cancellation.


Payment Plan (Direct Debit Service)

Payment Plan Application
A Payment Plan Application Form must be completed by each customer and accepted by Points of Difference Events and its service provider.

The Payment Plan Direct Debit Service is offered through Ezypay and is subject to their terms and conditions as applicable.

Payment Plan Deposit
The first Direct Debit payment acts as a non-refundable deposit and secures your booking. Any cancellations are subject to the Payment Plan Cancellation Conditions as stated below.

Payment Plan Fees
Set-up Fee $25

Transaction Fees

  • Bank, Building Societies, Credit Unions:  1.25%

  • Visa and MasterCard:  2.52%

  • AMEX/Diners:  5.03%

These fees will be charged to you in addition to your FFST quoted price

Payment Plan Failures
If a Direct Debit fails, a Failed Transaction Fee will be charged to you of $13.08.

Incorrect Bank Details: if the provided banking details are incorrect, a fee of $25 will be charged for each failure.

Scheduled Direct Debit Amounts may be suspended until the outstanding amount is recovered. Once the amount is recovered, direct debits will resume and outstanding amounts added to the next scheduled debit.

Payment Plan Variations
Any customer-initiated variation to the agreed Payment Plan will be subject to a Variation Fee of $25

Payment Plan Cancellation Condition

  • Bookings cancelled on or before June 19, 2012 are subject to a cancellation fee of 100% of the Deposit paid, or an Accumulated Payment Value of $500, whichever is greater;

  • Bookings cancelled after June 19, 2012 and before July 19 2012 are subject to a cancellation fee 50% of the Total Cost or 80% of Accumulated Payment Value, which ever is greater;

  • Bookings cancelled on or after July 19, 2012 are subject to a cancellation fee of 100% of the Total Cost or 100% of Accumulated Payment Value, that is there will be no refund.

For clarification: Accumulated Payment Value shall be all monies paid to PoDE via a Payment Plan Agreement.

In purchasing tickets to the Frosty Fruits Ski Trip, I certify that I am at least 18 years of age. I have read the above terms and conditions and agree to the provisions thereof.
